Pending Amendments to Regulations and Pending New Regulations

201 KAR 2:210, Patient records, drug regimen review, patient counseling, and final product verification​. Amendment. This amendment re-orders the sections of the regulation and adds sections and definitions regarding the regulation of automated filling systems and final product verification. Public comments shall be received through August 31, 2024. 

201 KAR 2:480, Telework and Electronic Supervision for Remote Prescription Processing​. New Regulation. KRS 315.020(5) authorizes order entry, order entry verification and drug regimen review as tasks that can be performed outside of the permitted space of the pharmacy. The purpose of this administrative regulation is to provide minimum requirements for pharmacies located in Kentucky engaged in remote prescription processing conducted via telework and to establish rules for electronic supervision. Public comments shall be received through August 31, 2024. 

201 KAR 2:370, Pharmacy Services in long-term care facility.​ Amendment filed June 4, 2024: This amendment defines “tamper-resistant secure container" and amends the definition for “long-term care facility." Public comments shall be received through August 31, 2024.

201 KAR 2:050, LIcenses and permits; fees.​ Amendment filed April 15, 2024: This amendment creates a fee for a non-resident pharmacist license and renewal. This amendment also clarifies that all fees are non-refundable and that applications shall expire after one year of receipt. 

201 KAR 2:030, License transfer and non-resident pharmacist license.​ Amendment filed April 15, 2024: This amendment creates a new type of pharmacist license for non-resident pharmacists. This is a limited license with a $50 application fee and renewal fee. The non-resident pharmacist license is exempt from CE and the MPJE. 

201 KAR 2:465, Non-Resident Pharmacy Applications and Waivers​. New Administrative Regulation filed April 15, 2024: This regulation details the application process for non-resident pharmacies and clarifies language in KRS 315.0351, including the waiver for “isolated transactions" language. This regulation does require licensure of any pharmacist engaging in the practice of pharmacy for a Kentucky resident.
